1. General provisions

1.1. This privacy policy governs the principles of collecting, processing, and storing personal data. Personal data is collected, processed, and stored by the data controller, Kash OÜ (registry code 17047454), referred to below as "we" or "the data controller".

1.2. A data subject, for the purposes of this privacy policy, is a customer or any other natural person whose personal data is processed by the data controller.

1.3. A customer, for the purposes of this privacy policy, is anyone who purchases goods or services from the data controller's website.

1.4. The data controller follows the data processing principles set out in applicable law, including processing personal data lawfully, fairly, and securely, and is able to demonstrate that personal data has been processed in accordance with the law.

2. Collection, processing, and storage of personal data

2.1. The personal data we collect, process, and store is collected electronically, mainly through the website and by email.

2.2. By sharing their personal data, the data subject grants the data controller the right to collect, organise, use, and manage, for the purposes set out in this privacy policy, the personal data that the data subject shares with the data controller directly or indirectly when purchasing goods or services on the website.

2.3. The data subject is responsible for ensuring that the data they provide is accurate, correct, and complete. Knowingly providing false information is considered a breach of this privacy policy. The data subject must promptly inform the data controller of any changes to the data they have provided.

2.4. The data controller is not liable for damage caused to the data subject or to third parties as a result of the data subject providing false information.

3. Processing customers' personal data

3.1. The data controller may process the following personal data of the data subject:

  • First and last name
  • Date of birth
  • Phone number
  • Email address
  • Delivery address
  • Bank account number
  • Payment card details

3.2. In addition to the above, the data controller has the right to collect data about the customer that is available in public registers.

3.3. The legal basis for processing personal data is Article 6(1)(a), (b), (c), and (f) of the General Data Protection Regulation:

  • the data subject has given consent to the processing of their personal data for one or more specific purposes;
  • processing is necessary for the performance of a contract to which the data subject is party, or in order to take steps at the request of the data subject before entering into a contract;
  • processing is necessary for compliance with a legal obligation to which the data controller is subject;
  • processing is necessary for the purposes of the legitimate interests pursued by the data controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, in particular where the data subject is a child.

3.4. Processing of personal data by purpose, and the maximum storage period:

  • Security: as required by law
  • Order processing: 10 years
  • Ensuring the operation of the online store's services: 10 years
  • Customer management: 10 years
  • Financial activity and accounting: as required by law
  • Marketing: 10 years

3.5. The data controller has the right to share customers' personal data with third parties, such as authorised processors, accountants, transport and courier companies, and payment service providers. The data controller remains the controller of the personal data. Payments in this store are processed through Shopify Payments, and the personal data necessary for processing a payment is shared with Shopify's payment processing partners only as required to complete the transaction.

3.6. When processing and storing the data subject's personal data, the data controller implements organisational and technical measures that protect personal data against accidental or unlawful destruction, alteration, disclosure, and any other unlawful processing.

3.7. The data controller stores data subjects' data depending on the purpose of processing, but for no longer than 10 years.

4. Rights of the data subject

4.1. The data subject has the right to access and review their personal data.

4.2. The data subject has the right to receive information about the processing of their personal data.

4.3. The data subject has the right to supplement or correct inaccurate data.

4.4. Where the data controller processes the data subject's personal data on the basis of consent, the data subject has the right to withdraw that consent at any time.

5. Final provisions

5.1. This privacy policy has been prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (the General Data Protection Regulation), the Estonian Personal Data Protection Act, and other applicable Estonian and European Union legislation.

5.2. The data controller has the right to partially or fully amend this privacy policy, and will notify data subjects of any changes via catpip.com.
